The Licensing Act 2003 (Licensing statement period) Order 2004

The Secretary of State, in exercise of the powers conferred upon her by section 5(2)(a) of the Licensing Act 20031, hereby makes the following Order:

S-1 Citation and commencement and interpretation

1.—(1) This Order may be cited as the Licensing Act 2003 (Licensing statement period) Order 2004 and shall come into force on the day after the day on which this Order is made.

(2) In this Order, “the Act” means the Licensing Act 2003.

2. For the purposes of section 5(2) of the Act, the three year period2shall begin on 7th January 2005.

This Order appoints, for the purposes of section 5 (statement of licensing policy) of the Licensing Act 2003, 7th January 2005 as the day the first period of three years begins in respect of which each licensing authority must determine its policy with respect to its licensing functions and publish a statement of that policy. It will govern the start of subsequent three year periods for the purposes of that section.
