The Maior of Lincolns Case. Huuddleston and Hills Case

the makjr of lenoolnh case. huudleston and hills case. In an attachment against the Maior of Lincoln, and the steward of the court there beipg Colshil, it was said, that if a writ of error be directed to an inferiour court, they ought to execute it in all things although that their fee be not paid, nor tendered to them, and Mr. Man secondarie to Roper said, that the fee which is demanded by them ought to be indorsed upon the return of the writ of error, so that the judges may judge of it if it be reasonable, and divers presidents warrant that accordingly. Huddleston and Bill against Bows, an elegit upon a judgement issued at the suit of Hill, and after Hill died, and his eldest son sued a scire facias upon the said judge-mejit, and holden that it lieth not. If a man s(ie in the ecclesiastical court for tithes of headlands, the defendant may have a prohibition, but by some he ought to suggest that they are but small...
