The Midland Metro Order 2010

Made 29th June 2010

Coming into force 20th July 2010

An application has been made to the Secretary of State in accordance with the Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 20061for an Order under sections 1 and 5 of the Transport and Works Act 19922(“the 1992 Act”).

The Secretary of State has determined to make an Order giving effect to the proposals comprised in the application without modifications.

Notice of the Secretary of State’s determination was published in the London Gazette on 25th June 2010.

The Secretary of State, in exercise of the powers conferred by sections 1 and 5 of, and paragraph 1 of Schedule 1 to, the 1992 Act, makes the following Order:—

S-1 Citation and commencement

1. This Order may be cited as the Midland Metro Order 2010 and shall come into force on 20th July 2010.

S-2 Modification of Midland Metro Act 1989

Modification of Midland Metro Act 1989

2.—(1) Subsection (1) of section 9 (requirements applicable to tramways) of the Midland Metro Act 19893, including that provision as applied by any of the other Midland Metro Acts specified in paragraph (2), shall cease to have effect.

(2) The other Midland Metro Acts specified are:

The Midland Metro Act 19924;

The Midland Metro (No.2) Act 19925;

The Midland Metro Act 19936; and

The Midland Metro (No.2) Act 19937.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order repeals in relation to the existing Midland Metro light rail system a statutory requirement relating to the minimum distance between passing carriages in order to achieve consistency with current guidance.


(2) 1992 c. 42. Part 1 of this Act is amended by S.I. 1995/1541, 1998/2226, 2000/3199 and 2006/958.
