The National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) (Amendment) Regulations 2008

The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 7(1), 8, 272(7) and 273(1) and (4) of the National Health Service Act 20061:

S-1 Citation, commencement, interpretation and application

Citation, commencement, interpretation and application

1.—(1) These Regulations may be cited as the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) (Amendment) Regulations 2008 and shall come into force on 1st April 2008.

(2) In these Regulations, “the principal Regulations” means the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) Regulations 20022.

(3) These Regulations apply in relation to England.

S-2 Amendment of Schedule 5 to the principal Regulations

Amendment of Schedule 5 to the principal Regulations

2. In Schedule 5 to the principal Regulations (Secretary of State’s functions under section 3(1) of the National Health Service Act 2006 exercisable by Strategic Health Authorities for the purpose of securing the provision of services: specified services)3

(a) after the entry numbered 13 insert—

“13A. Islet transplantation service”;

(b) after the entry numbered 23 insert—

“23A. Proton beam therapy service”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which apply in relation to England, further amend the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) Regulations 2002 (“the principal Regulations”).

Regulation 2 amends Schedule 5 to the principal Regulations so that Strategic Health Authorities may secure the provision of the following health services, namely islet transplantation service and proton beam therapy service.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
