The National Minimum Wage (Amendment) Regulations 2018

Made 29th March 2018

Coming into force 1st April 2018

The Secretary of State, in exercise of the powers conferred by sections 1(3), 2, 3 and 51 of the National Minimum Wage Act 19981, makes the following Regulations.

A draft of these Regulations was laid before Parliament in accordance with section 51(5) of the National Minimum Wage Act 1998 and approved by a resolution of each House of Parliament.

1. These Regulations may be cited as the National Minimum Wage (Amendment) Regulations 2018 and come into force on 1st April 2018.

2.—(1) The National Minimum Wage Regulations 20152are amended as follows.

(2) In regulation 4 (the national living wage) for “£7.50” substitute “£7.83”.

(3) In regulation 4A(1) (workers who qualify for the national minimum wage at a different rate)—

(a)

(a) for “£7.05” substitute “£7.38”;

(b)

(b) for “£5.60” substitute “£5.90”;

(c)

(c) for “£4.05” substitute “£4.20”;

(d)

(d) for “£3.50” substitute “£3.70”.

(4) In regulation 16(1) (amount for provision of living accommodation) for “£6.40” substitute “£7.00”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Minimum Wage Regulations 2015 (“the 2015 Regulations”). These Regulations come into force on 1st April 2018.

Regulation 2(2) increases the rate of the national minimum wage for workers who are aged 25 or over (“the national living wage rate”) from £7.50 to £7.83 per hour (regulation 4 of the 2015 Regulations).

Regulation 2(3)(a) increases the rate of the national minimum wage for workers who are aged 21 or over (but not yet aged 25) from £7.05 to £7.38 per hour (regulation 4A(1)(a) of the 2015 Regulations).

Regulation 2(3)(b) increases the rate for workers who are aged 18 or over (but not yet aged 21) from £5.60 to £5.90 per hour (regulation 4A(1)(b) of the 2015 Regulations).

Regulation 2(3)(c) increases the rate for workers who are under the age of 18 from £4.05 to £4.20 per hour (regulation 4A(1)(c) of the 2015 Regulations).
