Her Majesty, in pursuance of section 4(2) of the Parliamentary Commissioner Act 19671, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1. This Order may be cited as the Parliamentary Commissioner Order 2004 and comes into force on 15 November 2004.

S-2 Government Actuary’s Department

Government Actuary’s Department

2.—(1) In Schedule 2 to the Parliamentary Commissioner Act 1967 (departments etc. subject to investigation), insert at the appropriate place –

“Government Actuary’s Department.”.

(2) In the notes to Schedule 2, after paragraph 12, insert –

13. In the case of the Government Actuary’s Department an investigation may be conducted under this Act only in respect of the giving of advice by the Government Actuary’s Department on or before 26 April 2001 relating to the exercise of functions under-

(a) Part 2 of the Insurance Companies Act 19822, or

(b) any other enactment relating to the regulation of insurance companies within the meaning of that Act.”.

This Order in Council amends the list of government departments and other authorities specified in Schedule 2 to the Parliamentary Commissioner Act 1967 by adding the Government Actuary’s Department. The result of this amendment is that the Parliamentary Commissioner will be able, subject to the conditions set out in that Act, to investigate action taken by or on behalf of the Government Actuary’s Department in the exercise of its administrative functions. The Order specifies that investigations may only be carried out in respect of the giving of advice by the Government Actuary’s Department on or before 26 April 2001 relating to the exercise of certain functions which relate to the regulation of insurance companies (as defined by the Insurance Companies Act 1982).
