(3) Where notice is deemed to have been given in accordance with parag raph (2) and
subsequently the person is located, the per son is to be given a copy of the notice and
details of when and how it was deemed to be served as soon as is pract icable.
(4) Where a notice is sent by post in accordance w ith paragraph (1)(c) it shall be deemed
to have been served, unless the cont rary is proved, on the second day after it was posted.
(5) For the purp oses of paragraph (4) the period is to be calculated—
(a) excluding the day on which the notice is posted, and
(b) excluding any day which is not a business day.
(6) In t his regulation, ‘business day’ means any day other than Sat urday or Sunday,
a day which is a bank holiday under the Bank ing and Financial Dea lings Act 1971 i n
the part of the United Ki ngdom to which the notice is sent, Christmas Day or Goo d
Fri da y.
(7) A notice to be given to a family member i n accordance with section 10(2) of t he
Act may, in the case of a child below the age of 18 who does not have a representative, be
given to P.

1.— (1) These Regulations may be cited as the Proposed M arriages and Civil
Partnerships (Meani ng of Exempt Persons and Notice) Regulations 2015.
(2) They come into force on 2nd Ma rch 2015.
(3) Regulations 5 to 7 ex tend to England and Wales only.
