The Scottish Commission for Human Rights (Specification) Order 2008

Made 5th November 2008

Coming into force in accordance with article 1

At the Court at Buckingham Palace, the 5th day of November 2008

This Order is made in exercise of the powers conferred by section 9(6)(d) of the Scottish Commission for Human Rights Act 20061and all other powers enabling Her Majesty to do so.

In accordance with section 9(7) of that Act a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Accordingly, Her Majesty is pleased, by and with the advice of Her Privy Council, to order as follows.

1.—(1) This Order may be cited as the Scottish Commission for Human Rights (Specification) Order 2008.

(2) It comes into force on the day after the day on which it is made.

S-2 Specification of international convention

Specification of international convention

2. The United Nations Convention on the Rights of Persons with Disabilities adopted by Resolution A/RES/61/106 (13th December 2006) of the General Assembly of the United Nations is specified for the purposes of section 9 (restrictions as to scope of inquiry) of the Scottish Commission for Human Rights Act 2006.

(This note is not part of the Order)

This Order specifies the United Nations Convention on the Rights of Persons with Disabilities for the purposes of section 9 of the Scottish Commission on Human Rights Act 2006. This allows the Commission to conduct inquiries into the policies and practices of public authorities and institutions where the subject matter of the inquiry is about whether the human rights contained in the Convention are being respected.
