The Toot Hill School (School Day and School Year Regulations) Order 2007

The governing body of the Toot Hill School1(“the School”), a qualifying body for the purposes of Chapter 1 of Part 1 of the Education Act 20022(“the Act”) have, in accordance with section 4(2) of the Act, consulted the local education authority and such persons as appear to them to be appropriate, including the parents of the registered pupils at the School and the staff working at the School.
It is the opinion of the Secretary of State pursuant to section 1(1)(a) of the Act, having regard to the matters set out in section 1(2), that the implementation by the governing body of the School of the provisions of this Order may contribute to the raising of educational standards in England.
In exercise of the powers conferred on the Secretary of State by section 2(1) of the Act, the Secretary of State for Children, Schools and Families, on the application of the governing body of the School, makes the following Order:
Citation and commencement
1. This Order may be cited as the Toot Hill School (School Day and School Year Regulations) Order 2007 and comes into force on 1st December 2007.
Relaxation of the Education (School Day and School Year) (England) Regulations 1999
2. In respect of the application of regulation 3(2) of the Education (School Day and School Year) (England) Regulations 19993, to the governing body of the School, in relation to the school years42007-2008, 2008-2009 and 2009-2010, for the number “380” substitute “378”.
Time period
3. This Order has effect up to and including 31st August 2010.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order is made under section 2 of the Education Act 2002. Article 2 provides for the number of school sessions required at Toot Hill School to be reduced from 380 to 378 in the school years 2007-2008, 2008-2009 and 2009-2010 in order to facilitate the governing body’s innovative project of restructuring the school, increasing the length of the learning week and introducing a new tiering structure for pupils.
