The Welsh Language (Gambling and Licensing Forms) Regulations 2010

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 151(2), 159(6) to (8), 160(1) and (2), 164(2) and (3), 165(2) and (3), 187(3) and (4), 188(2), 189(4), 195(3), 196(3), 197(2) to (6), 200(4) and (5), 203(2), 204(2) and (3), 213(g), 216, 224(4) and (8), 355(1), paragraph 11 of Schedule 10, paragraph 42(2) of Schedule 11, paragraphs 2(c) and (d) and 11(1) of Schedule 12, paragraph 7(1) of Schedule 13 and paragraph 12(1) of Schedule 14 to the Gambling Act 20051, sections 17(3) to (6), 24(1), 25A(1), 29(6), 30(2) and (3), 34(5), 37(3), 41A(2) and (4), 41D(1), 42(3), 47(2) and (3), 51(2) and (3), 54, 71(4) to (6), 78(1), 84(2) and (4), 86A(2) and (4), 87(2) and (3), 91, 100(4) and (5), 102(2), 107(7), 120(2), 125(4), 133(1), 167(4), 178(1), 193 and 197(2) of the Licensing Act 20032and section 26(3) of the Welsh Language Act 19933:
Citation, commencement and application
1.—(1) These Regulations may be cited as the Welsh Language (Gambling and Licensing Forms) Regulations 2010 and come into force on 6th November 2010.
(2) These Regulations apply in relation Wales.
Prescribed forms (gambling)
2. The form set out in Schedule 1 to these Regulations is prescribed as the Welsh and bilingual version of the form set out in Schedule 1 to the Gambling Act 2005 (Family Entertainment Centre Gaming Machines) Regulations 20074.
3. The form set out in Schedule 2 to these Regulations is prescribed as the Welsh and bilingual version of the form set out in Schedule 1 to the Gambling Act 2005 (Prize Gaming) (Permits) Regulations 20075.
4.—(1) The forms set out in Schedules 3 to 13 to these Regulations are prescribed as the Welsh or bilingual versions of the forms set out in Schedules 1 to 11 to the Gambling Act 2005 (Premises Licences and Provisional Statements) Regulations 20076(“the 2007 Regulations”) as indicated in the table in Schedule 27 to these Regulations.
(2) In that table—
(a)
(a) column 1 lists the Welsh or bilingual versions of the forms as set out in these Regulations by reference to the corresponding forms set out in the 2007 Regulations listed in column 2, and
(b)
(b) column 2 lists the forms as these are set out in the 2007 Regulations.
5. The form set out in Schedule 14 to these Regulations is prescribed as the Welsh and bilingual version of the form set out in the Schedule to the Gambling Act 2005 (Licensed Premises Gaming Machine Permits) (England and Wales) Regulations 20077.
6. The forms set out in Schedules 15 to 17 to these Regulations are prescribed as the Welsh and bilingual versions of the forms set out in Schedules 1 to 3 respectively to the Gambling Act 2005 (Club Gaming and Club Machine Permits) Regulations 20078.
7. The forms set out in Schedules 18 to 23 to these Regulations are prescribed as the Welsh versions of the forms set out in Schedules 1 to 6 respectively of the Gambling Act 2005 (Premises Licences) (Review) Regulations 20079.
8. The form set out in Schedule 24 to these Regulations is prescribed as the Welsh version of the form set out in the Schedule to the Small Society Lotteries (Registration of Non-Commercial Societies) Regulations 200710.
9. The forms set out in Parts 1 to 2 of Schedule 25 to these Regulations are prescribed as the Welsh versions of the forms set out in Parts 1 to 2 respectively of Schedule 1 to the Gambling Act 2005 (Temporary Use Notices) Regulations 200711.
10. The form set out in Schedule 26 to these Regulations is prescribed as the Welsh version of the form set out in Schedule 2 to the Gambling Act 2005 (Temporary Use Notices) Regulations 2007.
Prescribed forms (licensing)
11. The Licensing Act 2003 (Welsh Language Forms) Order 200712 is revoked.
12. The forms set out in Schedules 28 to 43 to these Regulations are prescribed as the Welsh and bilingual versions of the forms set out in Schedules 1 to 13 respectively of the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 200513.
13. The forms set out in Schedules 44 to 46 to these Regulations are prescribed as the Welsh versions of the forms set out in Schedules 1 to 3 respectively of the Licensing Act 2003 (Personal licences) Regulations 200514.
14. The forms set out in Schedules 47 and 48 to these Regulations are prescribed as the Welsh versions of the forms set out in Schedules 1 and 2 respectively of the Licensing Act 2003 (Permitted Temporary Activities) (Notices) Regulations 200515.
Conditions of use
15. The forms prescribed by these Regulations may be used only in dealings by or with licensing authorities in Wales.
16. In regulation 2(2) of the Gambling Act 2005 (Proceedings of Licensing Committees and Sub-committees) (Premises Licences and Provisional Statements) (England and Wales) (Regulations) 200716for “licensing committing” substitute “relevant committee”.
