Her Majesty, in pursuance of section 1 of the Ministers of the Crown Act 19751, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.—(1) This Order may be cited as the Transfer of Functions (Civil Defence) Order 2002.

(2) This Order shall come into force on 25th November 2002.

2. A function of the Secretary of State which arises by virtue of the proviso to section 9(2) of the Civil Defence Act 19482(ministerial responsibility) shall be exercisable concurrently with the Chancellor of the Duchy of Lancaster.

(This note is not part of the Order)

This Order enables the Chancellor of the Duchy of Lancaster to exercise any function of the Secretary of State arising under the proviso to section 9(2) of the Civil Defence Act 1948. The effect of the Order is that the Chancellor of the Duchy of Lancaster will be able, in the same way as a Secretary of State, to exercise any function under the Act which has not been specifically designated by Order in Council as the function of another Minister.
