Her Majesty, in pursuance of section 1 of the Ministers of the Crown Act 19751, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:–

1.—(1) This Order may be cited as the Transfer of Functions (Minister for the Civil Service and Treasury) Order 2000.

(2) This Order shall come into force on 1st April 2000.

S-2 Transfer of functions relating to computers and telecommunications

2. The functions of the Minister for the Civil Service with respect to the centralised procurement or provision of goods, services and facilities in the fields of computers and telecommunications shall be exercisable concurrently with the Treasury.

3.—(1) Any rights and liabilities to which the Minister for the Civil Service is entitled or subject in connection with those functions under any contract–

(a)

(a) made before the commencement of this Order, and

(b)

(b) in relation to which he acts or acted through the executive agency known as the Central Computer and Telecommunications Agency,

are hereby transferred to the Treasury.

(2) Accordingly, any such contract made before the commencement of this Order shall have effect so far as necessary for the purpose or in consequence of any transfer effected by this Order as if any reference to the Minister for the Civil Service or any officer of his (including any reference which is to be construed as such a reference) were a reference to the Treasury or an officer of the Treasury.

(3) This Order shall not affect the validity of anything done by or in relation to the Minister for the Civil Service before the commencement of this Order; and anything (including legal proceedings) which at the commencement of this Order is in process of being done by or in relation to the Minister for the Civil Service may, if it relates to any such contract, be continued by or in relation to the Treasury.
