Dear Alexis, Steve and Tim
Novation of the track access contract dated 4 May 2018 between
Network Rail Infrastructure Limited and South Yorkshire Supertram
Limited to South Yorkshire Future Trams Limited
We have today approved and directed the novation of the above track access contract
from South Yorkshire Supertram Limited to South Yorkshire Future Trams Limited, in
accordance with the Railways Act 1993 (the Act).
The parties submitted the Deed of Novation on 11 March 2024 and a further Deed of
Variation on 12 March 2024. The Deed of Variation was necessary to ensure that the
outcome of the Periodic Review 2023 will apply to South Yorkshire Future Trams Limited
and the track access contract.
We expect the parties to execute the Deed of Variation by 22 March 2024. A copy of the
directions and the signed Deed will be placed on our public register, copies of this letter,
the directions and the Deed will also be placed on the ORR website.
Once the Deed is signed, in accordance with section 72(5) of the Act, you must send a
copy to the ORR within 14 days.
