Approval of the eighth supplemental agreement to the track access
contract between Network Rail Infrastructure Limited (Network Rail) and
South Yorkshire Future Trams Limited (SYFTL) dated 4 May 2018
We have today approved the above supplemental agreement submitted to us formally on
26 March 2024 under section 22 of the Railways Act 1993 (the Act). This follows an earlier
informal submission of a draft agreement for our consideration. This letter explains the
reasons for our decision.
Purpose
The purpose of this agreement is to update the track access contract with the details of the
new train operator following the novation of the contract from South Yorkshire Supertram
Limited (SYSL) to South Yorkshire Future Trams Limited (SYFTL) on 22nd March 2024.
Industry consultation
No consultation took place as the proposed changes are purely administrative to reflect
the novation carried out under the terms of the contract.
ORR review
Our review of the application raised no concerns. We reviewed the supplemental
agreement and suggested minor drafting corrections to the parties.
