The Transfer of Functions (International Development) Order 1997

Her Majesty, in pursuance of sections 1 and 2 of the Ministers of the Crown Act 19751, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

S-1 Citation and commencement

1.—(1) This Order may be cited as the Transfer of Functions (International Development) Order 1997.

(2) This Order shall come into force on 22nd August 1997.

S-2 Interpretation

Interpretation

2.—(1) In this Order “the international development functions” means—

(a)

(a) the functions which were entrusted to the Secretary of State for Foreign and Commonwealth Affairs immediately before 1st May 1997 and which have, before the making of this Order, been entrusted to the Secretary of State for International Development, and

(b)

(b) the functions transferred by article 3.

(2) In this Order “instrument”, without prejudice to the generality of that expression, includes in particular Royal Charters, Orders in Council, Letters Patent, judgments, decrees, orders, rules, regulations, schemes, bye-laws, awards, contracts and other agreements, memoranda and articles of association, warrants, certificates and other documents.

3.—(1) The functions exercisable by the Secretary of State for Foreign and Commonwealth Affairs under the instruments listed in paragraph (2) are hereby transferred to the Secretary of State for International Development.

(2) The instruments mentioned in paragraph (1) are—

(a)

(a) the Royal Charter dated 1st April 1924, relating to the London School of Hygiene and Tropical Medicine2;

(b)

(b) the Royal Charter dated 24th April 1956, relating to the Royal Veterinary College2;

(c)

(c) the Articles of Association of The Crown Agents Foundation;

(d)

(d) the Memorandum of Association and Articles of Association of the Hydraulics Research Station Limited; and

(e)

(e) the Memorandum of Association and Articles of Association of The Institute of Development Studies.

S-4 Transfer of property, &c.

Transfer of property, &c.

4.—(1) Subject to paragraph (2), all property, rights and liabilities to which the Secretary of State for Foreign and Commonwealth Affairs is entitled or subject at the coming into force of this Order in connection with the international development functions are hereby transferred to the Secretary of State for International Development.

(2) Paragraph (1) shall not have effect in relation to immovable property.

S-5 Transfers: supplementary

5.—(1) This Order shall not affect the validity of anything done by or in relation to the Secretary of State for Foreign and Commonwealth Affairs before the coming into force of this Order.

(2) Anything which—

(a)

(a) has been, or has effect as if, done by or in relation to the Secretary of State for Foreign and Commonwealth Affairs in connection with the international development functions or anything transferred by article 4, and

(b)

(b) is in force at the coming into force of this Order,

shall, so far as necessary for continuing its effect after the coming into force of this Order, have effect as if done by or in relation to the Secretary of State for International Development.

(3) Anything (including any legal proceedings) which, at the coming into force of this Order, is in the process of being done by or in relation to the Secretary of State for Foreign and Commonwealth Affairs may, so far as it relates to—

(a)

(a) any of the international development functions, or

(b)

(b) anything to which article 4, or paragraph (2) above, relates,

be continued by or in relation to the Secretary of State for International Development.

(4) In this article, a reference to anything done by or in relation to the Secretary of State for Foreign and Commonwealth Affairs includes a reference to...
