The Plant Health (Forestry) (Phytophthora ramorum) (Great Britain) (Amendment) Order 2007

The Forestry Commissioners make the following Order in exercise of the powers conferred by sections 2 and 3(1), (2), (3) and (4) of the Plant Health Act 19671:
Title and commencement
1. This Order may be cited as the Plant Health (Forestry) (Phytophthora ramorum) (Great Britain) (Amendment) Order 2007 and comes into force on 31st December 2007.
Amendments to the Plant Health (Forestry) (Phytophthora ramorum) (Great Britain) Order 2004
2.—(1) The Plant Health (Forestry) (Phytophthora ramorum) (Great Britain) Order 20042is amended as follows.
(2) In article 2 (interpretation), in the definition of “susceptible bark”, replace the words after “Acer macrophyllumPursh.,” with “Aesculus californica(Spach) Nutt., Lithocarpus densiflorus (Hook. & Arn.) Rehd., Quercusspp. L. and Taxus brevifoliaNutt.”.
(3) In article 13 (offences)—
(a)
(a) for sub-paragraph (a) of paragraph (1) substitute—
“(a)
“(a) subject to paragraph (1A), he contravenes or fails to comply with article 3, 4, 5(1) or 9(1);”; and
(b)
(b) after paragraph (1), insert—
“1A Paragraph (1)(a) shall not apply where an article of any description is landed in Great Britain in contravention of a prohibition in this Order.”.
(4) In the Schedule, for the first column substitute—
