THE ALKALI, &C. WORKS REGULATION ORDER (SCOTLAND), 1933, DATED AUGUST 31, 1933, MADE BY THE DEPARTMENT OF HEALTH FOR SCOTLAND UNDER SECTIONS 9 AND 27 (AS APPLIED TO SCOTLAND BY SECTION 28) OF THE ALKALI, &C. WORKS REGULATION ACT, 1906 (6 EDW. 7. C. 14).(a)

The Department of Health for Scotland, in exercise of the powers competent to them under Sections 9 and 27 (as applied to Scotland by Section 28) of the Alkali, &c. Works Regulation Act, 1906, and of all other powers enabling them in that behalf, hereby order and prescribe as follows:—

1.—(1) This Order may be cited as the Alkali, &c. Works Regulation Order (Scotland), 1933.

(2) This Order shall apply to Scotland only.

(3) The Interpretation Act, 1889 applies to the interpretation of this Order as it applies to the interpretation of an Act of Parliament.

2. In this Order, unless the context otherwise requires,—

"The Act" means the Alkali, &c. Works Regulation Act, 1906.

"Work" means a work to which Section 9 of the Act applies.

"The Department" means the Department of Health for Scotland.

3. Every work shall be registered in a register to be kept by the Department at the offices of the Department in Edinburgh.

4. The register shall contain the particulars (hereinafter referred to as "the prescribed particulars") specified in the First Schedule to this Order.

5. An application for a certificate of registration of a work shall be made to the Department in writing and shall contain the prescribed particulars.

6. All certificates of registration shall be issued by the Departments in the form or substantially in the form set out in Part I of the Second Schedule to this Order.

7. No certificate of registration shall be issued by the Department in respect of any work unless and until an application has been made in the manner prescribed by Article 5 of this Order and the Department are satisfied that the conditions of registration required by subsection (5) of Section 9 of the Act have been complied with or dispensed with, and the Department are in receipt of the amount of stamp duty chargeable upon the certificate of registration under subsection (6) of Section 9 of the Act as amended by Section 47 of the Finance Act, 1922 (12 & 13 Geo. 5. c.17).
