Act, 1900.
CHAPTER ccxxiv.
An Act to authorise the Lord Provost Magistrates and A
Town Council of the City and Royal Burgh of Aberdeen
to make certain bridge and street improvements to
confer upon them new powers with respect to police
matters streets and buildings and for other purposes.
[6th August 1900.]
W
HEKEAS the lord provost magistrates and town council of
the city and royal burgh of Aberdeen (herein-after called
" the Corporation " and "the City" respectively) are vested with
the municipal and police administration of the city :
And whereas it is expedient that the Corporation should be
empowered to make and maintain the bridge and street widenings
and improvements and works herein-after described and to acquire
lands for the purposes thereof :
And whereas it is expedient in the interest of the good government
of the city that the further police powers herein-after mentioned
should be conferred on the Corporation:
And whereas it is expedient that the further powers herein-after
mentioned with respect to streets and buildings should be conferred
upon the Corporation:
And whereas it is expedient that the Corporation should be
authorised to borrow and raise money and to lery rates and assess-
ments and that the further powers in this Act contained should be
conferred on the Corporation :
And whereas the Corporation are the local authority within
the city under the Electric Lighting Acts 1882 and 1888 and the
Electric Lighting (Scotland) Act 1890 (herein-after referred to as
" the Electric Lighting Acts'") and the Aberdeen Electric Lighting
Order 1890:
And whereas by the Aberdeen Municipality Extension Act 1871
the Aberdeen Corporation Act 1881 and the Aberdeen Corporation

(Gas and
Water)
Act 1893
(herein-after referred
to as " the Gas
Acts
") the
Corporation were authorised
to
borrow Tarious sums
of
money
for the
purpose
of
their
gas
undertaking amounting
in all
to
one
hundred
and
seventy thousand pounds
:
And whereas under
the
Electric Lighting Acts
the
Corporation
are authorised from time
to
time
to
borrow money on
the
security
of
the
gas
rates leviable
and gas
rents and other revenues receivable by
them under
the Gas
Acts with
the
consent
of the
Secretary
for
Scotland
and
subject
to the
provisions
and
restrictions with respect
to borrowing
and the
repayment
of
loans contained
in the Gas
Acts
and
the
money
so
borrowed
is to be
deemed
to be
borrowed under
the enactments subject
to the
provisions
and
restrictions
of
which
it
is borrowed:
And whereas
the
amount which
the
Corporation
are
authorised
to borrow under
the Gas
Acts
for the
purposes
of the gas
under-
taking
is
insufficient
to
meet
the
expenditure
in
connection with
that undertaking
and the
electric lighting undertaking
and it is
expedient that they should
be
authorised
to
borrow additional
money
:
And whereas plans
and
sections showing
the
lines situations
and
levels
of the
bridge
and
street improvements authorised
by
this
Act
and also
a
book
of
reference
to
such plans containing
the
names
of
the owners
and
lessees
or
reputed owners
and
lessees
and of the
occupiers
of the
lands required
or
which
may be
taken
for the
purposes
or
under
the
powers
of
this
Act
were duly deposited with
the principal sheriff clerk
of the
county
of
Aberdeen
at his
office
in
Aberdeen
and are
herein-after respectively referred
to as the
deposited plana sections
and
book
of
reference:
And whereas
the
purposes
of
this
Act
cannot
be
effected without
the authority
of
Parliament:
May
it
therefore please Your Majesty that
it may be
enacted
and
be
it
enacted
by the
Queen's most Excellent Majesty
by and
with
the advice
and
consent
of the
Lords Spiritual
and
Temporal
and
Commons
in
this present Parliament assembled
and by
the authority
of
the
same
as
follows:

This
Act may be
cited
as the

The Lands Clauses Acts are except where expressly varied by Incorpora-
ting Act incorporated with and form part of this Act. tloa of

4.
In this Act the several words and expressions to which Interpreta-
meanings are assigned by the Acts incorporated herewith have the tlon-
same respective meanings unless there be something in the subject
or context repugnant to such construction.
5.
The following words and expressions in this Act have the Further
meanings hereby assigned to them (that is to say): mterpreta-
"
The
city " means the city and royal burgh of Aberdeen;
" The Corporation" means the lord provost magistrates and
town council of the city;
""The Act cf 1862 " means the Aberdeen Police and Waterworks
Act 1862;
"The Act of 1871 " means the Aberdeen Municipality Extension
Act 1871;
" The Act of 1881" means the Aberdeen Corporation Act
1881;
" The Act of 1891" means the Aberdeen Corporation Act 1891;
" The Citv Acts " means the Acts of 1862 1871 1881 and 1891
and the Aberdeen Police and "Waterworks Amendment Act
1867 the Aberdeen Extension and Improvement Act 1883
the Aberdeen Corporation "Water Act 1885 the Aberdeen
Corporation (G-as and Water) Act 1893 and the Aberdeen
Corporation Act 1899;
"'The
sheriff"
means the sheriff of Aberdeen Kincardine and
Banff;
*'
Daily penalty" means a penalty for each day an offence
continues after conviction
thereof;
"The magistrates" means the magistrates of the city and
includes the lord provost and baillies and "magistrate"
means any one of the magistrates;
" The surveyor " has the same meaning as is assigned to it by the
