The Access to Health Records (Control of Access) Regulations 1993

In exercise of the powers conferred by section 5(5) of the Access to Health Records Act 19901and of all other powers enabling me in that behalf, I hereby make the following Regulations:–

S-1 Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Access to Health Records (Control of Access) Regulations 1993 and shall come into force on 13th April 1993.

(2) In these Regulations, “the Act” means the Access to Health Records Act 1990.1

2. Access shall not be given under section 3(2) of the Act to any part of a health record which would disclose information showing that an identifiable individual was, or may have been, born in consequence of treatment services within the meaning of the Human Fertilisation and Embryology Act 19902.

(This note is not part of the Regulations)

These Regulations preclude access, under section 3(2) of the Access to Health Records Act 1990, to any part of a health record where the granting of access would disclose information showing that an identifiable individual was, or may have been, born as a consequence of treatment services provided in accordance with the Human Fertilisation and Embryology Act 1990 (which itself contains provisions regulating access to such information).
