Advertisements at Licensed
Betting Offices
ONE of
the
first things to note about advertisements and
other written matter exhibited at licensed betting offices
is
that
there is a difference between
the
law relating to
the
betting office itself and
that
relating to premises giving access
to such an office.
The
law is found both in
the
Betting, Gami.ng
and
Lotteries Act, 1963, and in
the
Betting (Licensed Offices)
Regulations, 1960.
The
Act applies to Scotland also
but
there
the
relevant Regulations are
the
Betting (Licensed Offices)
(Scotland) Regulations, 1961.
There
seems to be no significant
difference between
the
two sets of Regulations.
Section 10
(I)
of
the
Act of 1963 provides
that
abetting
office shall be managed in accordance with
the
rules set
out
in Schedule 4 to
the
Act, and s. 10 (5)
reads:-
"If,
save in a licensed betting office or in such manner
as may be prescribed on premises giving access to such an
office, any advertisement is
published-
(a) indicating
that
any particular premises are a licensed
betting office; or
(b) indicating where any such office may be found; or
(c) drawing attention to
the
availability of, or to
the
facilities afforded to persons resorting to, such offices (the
licensee or publisher of
the
advertisement shall be guilty of
an offence)."
Rule 3 of Schedule 4requires
the
licensee to display his
licence on
the
licensed premises, to exhibit there such notices
in such form and in such positions as may be prescribed and to
comply
with
any prescribed restrictions with respect to
the
exhibiting of other written matter or of signs of any description
on
the
licensed premises.
The
Betting (Licensed Offices) Regulations, 1960, provide
as
follows:-
