Her Majesty, in exercise of the powers conferred on Her by sections 8 and 57 of the Civil Aviation Act 1949 (a) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

Citation and commencement

1. This Order may be cited as the Air Navigation (Amendment) Order 1982 and shall come into operation for the purpose of Article 2(3) on 11th September 1982, for the purpose of Article 2(18)(c)(iii) on 11th May 1982, and for the purpose of Article 2(18)(c)(iv) on 1st January 1983 and for all other purposes on 11th March 1982.

Amendment of the Air Navigation Order 1980

2. The Air Navigation Order 1980 (b) shall be amended as follows:

(1) In the "ARRANGEMENT OF ORDER" at the beginning of the Order:

(a) for the heading to Article 36 there shall be substituted "Use of flight recording systems and preservation of records." and this heading shall be substituted in the Order;

(b) for the heading to Article 78 there shall be substituted "Customs and Excise airports.";

(2) Article 2(2) is hereby revoked;

(a) 1949 c.67.

(3) In Article 18 for paragraph (3) there shall be substituted the following paragraph:

"(3) For the purposes of this Article, a licence granted under the law of a Contracting State other than the United Kingdom or under the law of a relevant overseas territory purporting to authorise the holder thereof to act as a member of the flight crew of an aircraft, not being a licence purporting to authorise him to act as a student pilot only, shall, unless the Authority in the particular case gives a direction to the contrary, be deemed to be a licence rendered valid under this Order but does not entitle the holder—

(a) to act as a member of the flight crew of any aircraft flying for the purpose of public transport or aerial work or on any flight in respect of which he receives remuneration for his services as a member of the flight crew; or

(b) in the case of a pilot's licence, to act as pilot of any aircraft flying in controlled airspace in circumstances requiring compliance with the Instrument Flight Rules or to give any instruction in flying.";

(4) For Article 21 there shall be substituted the following Article:

"21.—(1) Every member of the flight crew of an aircraft registered in the United Kingdom and every person who engages in flying for the purpose of qualifying for the grant or renewal of a licence under this Order shall keep a personal flying log book in which the following particulars shall be recorded.

(a) the name and address of the holder of the log book;

(b) particulars of the holder's licence (if any) to act as member of the flight crew of an aircraft;

(c) the name and address of his employer (if any).

(2) Particulars of each flight during which the holder of the log book acted either as a member of the flight crew of an aircraft or for the purpose of qualifying for the grant or renewal of a licence under this Order, as the case may be, shall be recorded in the log book at the end of each flight or as soon thereafter as is reasonably practicable, including—

(a) the date, the places at which the holder embarked on and disembarked from the aircraft and the times during the course of a flight when he was acting in either capacity;

(b) the type and registration mark of the aircraft;

(c) the capacity in which the holder acted in flight;

(d) particulars of any special conditions under which the flight was conducted including night-flying and instrument flying;

(e) particulars of any test or examination undertaken whilst in flight.

(3) For the purposes of this Article, a helicopter shall be deemed to be in flight from the moment the helicopter first moves under its own power for the purpose of taking off until the rotors are next stopped.

(4) Particulars of any test or examination undertaken whilst in a flight simulator shall be recorded in the log book, including—

(a) the date of the test or examination;

(b) the type of simulator;

(c) the capacity in which the holder acted;

(d) the nature of the test or examination.";
