Introduction
[1] This is an application by Seamus Morgan for the issue of a Writ of Habeas
Corpus to secure release from imprisonment pursuant to a conviction imposed by
the Crown Court for one offence under section 11(1) of the Terrorism Act 2000,
namely belonging or professing to belong to a proscribed organisation. The
applicant is currently held in HMP Maghaberry pursuant to a committal warrant.
[2] This application began by way of ex parte application to the court. However,
the court pursuant to Order 54 Rule 2 (1)(a) of the Rules of the Court of Judicature
(Northern Ireland) 1980 (“Rules of the Court of Judicature”) directed an originating
motion and so the case proceeded, inter partes, with the relevant authority who are
