' an information against page. In an information against Page, and another upon the statute of 3 & 4 E. G, cap. 21, for buying of butter, and selling of the same by retail contrary to the form of the statute, upon not guiltie pleaded, the jury found one of them only guiltie both of buying and selling, and the other not guiltie: and it was moved, that no judgement may be given in this case, inasmuch as the action is conceived upon a joynt buying by two : and it appeareth that this is but by one, but it was argued that judgement ought to be given, for it cannot be intended in law, as to this purpose a joynt buying, LAME, 20.
