pasch. 23 car. banco regis. andrews & harborn. mich. 22 car. rot. 483. Soire facias. Scire facias was brought in Middlesex upon a recognizance taken before Justice Reeve at his chamber at Serjeants Inn in London, and judgment given in C. B. and ALBYN, 13. TRIN. 23 CAR. BANCO REGIS 889 upon a writ of error brought in this Court, it was moved, that it ought to have been brought in London where the recognizance was taken; for though the scire facias must be grounded upon a record, and the recognizance be no record till it be entred, yet after it is entred, it becomes a record by relation from the time of the recognizance. And Hall and Winkfields case, Hob. 195. was cited, and the case was much debated : and Roll (Bacon absent) said that the most ancient and proper course was to bring the scire facias where the recognizance was taken ; but he shewed in his hand a certificate of all the Prothonotaries of the C.
