A. draws a bill upon B. to the use of C. and upon non-payment C. protests the bill; he cannot sue A. unless he gives him notice that the bill is protested; for A. may have the effects of B. in his hands, by which he may satisfle himself. Note, It was said, if an action to recover lands of which a fine was levied, was brought and discontinued by the demandant, this would not amount to a claim.
