InAugust2021,aU.S.FederalDistrictCourtruledthat§1326oftheImmigration
NaturalizationAct(INA)whichcriminalizesillegalreentryviolatedtheEqualProtection
clauseoftheFifthAmendmentbecauseithasdisparateimpactuponanddiscriminatory
intentagainstMexicanandLatinxindividuals.While§1326hasbeenunsuccessfully
challengedinnumerousotherfederalcourts,USv.Carrillo-Lopezstandsoutinits
originalityofinterpretationregardingthediscriminatoryintentofafederalstatute.Inthis
casecommentary,thereasoningofthecasewillbeexplicated,followedbyananalysisof
theuniquestatutoryinterpretationappliedwithinthecontextofdiscriminatoryintent
doctrine.
