Application for permission to issue an additional claim under rules 20.4(2)(b), 20.5(1) or 20.7(3)(b)

  1. Parties should use Form N244. They should file an application notice together with a copy of the proposed additional claim in the form of an additional claim form or counterclaim as appropriate, verified by a statement of truth as required by PD20 paragraph 4.

  1. The application notice should include in the relevant part evidence stating:

(1) the stage which the proceedings have reached;

(2) the nature of the additional claim to be made or details of the question or issue which needs to be decided;

(3) a summary of the facts on which the additional claim is based; and

(4) the name and address of any proposed additional party.

  1. Where delay has been a factor contributing to the need for an application for permission to make an additional claim an explanation of the delay should be given by the evidence.

  1. Where possible the applicant should provide a timetable of the proceedings to date.

  1. Rules 20.5(2) and 20.7(5) allow applications to be made under these rules without notice unless the court directs otherwise.
