Application for permission to appeal a decision to the Upper Tribunal (Lands Chamber)

Applications for stay, suspension and postponement pending appeal.

Rules 6, 52 and 54 of The Tribunal Procedure (First-tier Tribunal) (Property Chamber) Rules 2013 and Section 6A of the Agriculture (Miscellaneous Provisions) Act 1954 as amended.

This is the form to complete if you wish to apply to the First-tier Tribunal (‘the tribunal’) for permission to appeal to the Upper Tribunal (Lands Chamber) against a decision of the tribunal.

Your application must be received by the tribunal within 28 days after the date on which the tribunal sent the decision to you (this means the latest of the dates that the tribunal sent to you (a) written reasons for the decision; (b) notification of amended reasons for, or correction of, the decision following a review; or (c) notification that an application to set aside has been unsuccessful). If you are sending or delivering your application to the tribunal later than the time so required, it will be necessary for you to request an extension of time and to give the reason(s) why your application was not received in time by completing the appropriate part of section 4.

If you wish to apply to the tribunal to postpone or suspend the effect of its decision, or to stay the implementation of the whole or part of its decision, pending the outcome of your appeal you must do so at the same time as you apply to the tribunal for permission to appeal: you must also provide reasons for your application to suspend, stay or postpone and provide notice of the application to the other parties. You can do so by completing the appropriate parts of section 6, and sending or delivering copies of this document to the other parties.

Your completed application form and any accompanying documents must be delivered to the tribunal office by post or hand delivery. Emailed and faxed copies will not be accepted without prior arrangement with the tribunal and must be followed by hard copies by post or hand delivery.

If filling in by hand, this form must be completed in black ink; using BLOCK LETTERS. Please tick any boxes which apply. If necessary, ensure that all separate sheets used are numbered and contain the Applicant’s full name.
