Application for refund of
Employment Tribunal fees
Refund Form 1/2–CR

Refund Form 1/2-CR for claimants or respondents (06.18)
This is the form for persons or organisations who were the single claimant in an employment tribunal claim
(e.g. an employee who brought a tribunal claim against their employer) or who were the respondent in an
employment tribunal claim (e.g. an employer which had a tribunal claim brought against them).
There is a separate form for persons who were representatives or sponsors of a party to an employment
tribunal claim, and the lead claimant in multiple claims of 11 or more (Form 3-S).
If you were an individual claimant or were the respondent to a claim, but your circumstances are dierent
to those listed below, please check the guidance to make sure you are eligible, and then tell us why in
question 2.7.
If you paid fees for more than one claim, please ll in a separate copy of Section 2 for the other cases, and
send it with this form.
If you were part of a multiple claim of 10 people or under, you can use this form to claim your portion of
the total fee refund. On receiving your application, we will write to the rest of the claimants in the multiple
case to inform them that an application has been made and to ask if they also want to apply. They will be
given 28 days to reply. If all of that proceeds without issue we will then process the application and issue
repayment.
For multiple claims of 11 or more, a single payment will only be paid to the person who paid the fee and
proof of payment will be required. You will need to complete Refund Form 3-S.
