Whereas the General Nursing Council for England and Wales have, in pursuance of their powers under section 2 of the Nurses Act, 1943, amended the Assistant Nurses Rules, 1945(a), and have submitted the amendments to the Minister of Health for his approval;

Now, therefore, the Minister of Health, in exercise of his powers under section 16 of the Nurses Act, 1943, and of all other powers enabling him in that behalf, hereby approves the said amendments in the form set out in the schedule hereto.

This instrument may be cited as the Assistant Nurses (Amendment) Rules, Approval Instrument, 1948, and shall come into operation on the 31st day of December, 1948.

SCHEDULE

GENERAL NURSING COUNCIL FOR ENGLAND AND WALES

The Nurses Act, 1943

The General Nursing Council for England and Wales in the exercise of their powers under section 2 of the Nurses Act, 1943, hereby make the following Rules:—

1.—(1) These Rules may be cited as the Assistant Nurses (Amendment) Rules, 1948, and shall be read as one with the Assistant Nurses Rules, 1945.

(a) The text of the 1945 Rules as amended by these Rules is printed by J. S. Forsaith & Son, Ltd., 329, Bethnal Green Road, London, E.2. The 1945 Rules were not published in the S.R. & O. series.

By Article 1(1) of the Statutory Instruments (Confirmatory Powers) Order, 1947 (S.I. 1948 (No. 2) I, p. 4008) the approving document constitutes a statutory instrument, to which the Rules are scheduled.

(2) These Rules and the Assistant Nurses Rules, 1945, may be cited together as the Assistant Nurses Rules, 1945 and 1948.

2. The Rules contained in Part VII (Assistant Nurses Enrolled in Scotland) of the Assistant Nurses Rules, 1945, are hereby revoked and the following Rules shall be substituted therefor:—

"PART VII

ASSISTANT NURSES ENROLLED IN SCOTLAND OR NORTHERN IRELAND

Rule 39—Any person whose name is included in the Roll kept by the General Nursing Council for Scotland or by the Joint Nursing and Midwives Council for Northern Ireland shall, on making application to the Registrar and paying a fee of 10s. 6d., and on production of a certificate issued by the Registrar of the Council on whose Roll the said person is enrolled to the effect that her name has been entered and is included in such Roll, and of a complete copy of that entry, be entitled to be admitted to the Roll of this Council.

Rule 40—In the event of the removal or restoration after removal of the name of an Assistant Nurse from the Roll under Rules 30 to 38 hereof inclusive, notification of the fact shall be forthwith sent by the Registrar to the General Nursing Council for Scotland or to the Joint Nursing and Midwives Council for Northern Ireland, as the case may be, if the Council is aware that such Assistant Nurse is or was enrolled in Scotland under the Nurses (Scotland) Act, 1943, or in Northern Ireland under the Nurses Act (Northern Ireland), 1946.

Rule 41—In the event of the Council receiving a notification from the General Nursing Council for Scotland or the Joint Nursing and Midwives Council for Northern Ireland, that the name of any Assistant Nurse enrolled by either or both of those Councils has been removed from the Roll in Scotland or Northern Ireland by reason of a finding by the appropriate Council that such Assistant Nurse has been guilty of any misconduct, if the name of such Assistant Nurse is also included in the Roll, the Committee may at their absolute discretion forthwith remove the name of such Assistant Nurse from...
