In setting out a recognizance of bail on oyer, the plaintiff ought to shew in what term it was taken. A scire facias against bail. The writ set out a recovery against Russel, cumque etiara E. T. de &c. et J. F. de &c. alias scilicet termino aancti Hilarii ultimo praeterito in eadem curia nostra coram uobis apud Westmonasterium personaliter venere et devenere plegii, &c. that if judgment should be against the defendant, that the money recovered should be levied of their lauds and chattels, si contingat that the defendant should not pay it, nee se prisonae maresealciae nostrae ea occasione reddere, praedictus tamen the defendant debitum, &c. nondum solvit nee se prisonae marescalli maresealciae nostrae hucusque reddiclit prout, &c. the defendants pray oyer of the recognizance, and it is entred in haec verba.
