Basic Information

1.1 INTRODUCTION

The third edition of this book aims to provide greater coverage of the main aspects of agricultural tenancy law than the previous editions, which means there have been some changes made to the contents from those in the second edition.

The chapter in the previous edition on lettings of residential accommodation to farm workers has been omitted in favour of a more extensive consideration of the tenancy legislation itself, further practical issues arising from both of the principal statutes and advice on drafting and guidance on dealing with succession applications, whether acting for the applicant member of the tenant’s family or the landlord.

The two principal statutes whose provisions govern agricultural tenancies are the Agricultural Holdings Act 1986 (the 1986 Act) and the Agricultural Tenancies Act 1995 (the 1995 Act). The Acts are referred to throughout, except in the precedent documents and notices, as the 1986 Act and the 1995 Act.

The former deals with lettings of agricultural property up to 31 August 1995, and the latter with lettings from 1 September 1995 – subject to a few exceptions.

This book is directed primarily at non-specialist professional advisers, in particular solicitors and rural practice surveyors who wish to pick up the general principles of agricultural tenancy law. In addition, it is hoped that it will be useful for students studying agricultural law as well as landowners and tenants. It is intended to provide a basic background and some practical guidance.
