CHAPTER clxxi.
An Act to authorise the construction of additional Docks AX>-1882-
and other works at Belfast ; to extend the powers of the
Belfast Harbour Commissioners ; and for other purposes.

TTTHEUEAS by tbe Belfast Harbour Act 1847 (herein-after îo&ilVict.
\V called "the Act of 1847") the Belfast Harbour Commis- C-R
sioners (herein-after called " tbe Commissioners ") were incorporated
with power to exécute certain works and for tbat purpose to
borrow money and acquire lands and to levy rates as in tbat Act
mentioned And by the Belfast Port and Harbour Conservancy i5&i6Vict.
Act 1852 (herein-after called " tbe Act of 1852 ") further provision c-cxxL
was made for the conservancy of the port and harbour of Belfast :
And whereas by the Belfast Dock Act 1854 (herein-after called i7&i8Vict.
" the Act of 1854") tbe Commissioners were authorised to make c-xlv-
new docks and other works at Belfast and to borrow money and
acquire lands as in tbat Act mentioned :
And whereas the borrowing powers of the Act of 1854 hâve not
been exercised but tbe Commissioners bave out of moneys borrowed
under former Acts and out of revenue purcbased tbe lands and
executed portions of tbe works authorised by that Act :
And whereas by the Belfast Harbour Act 1870 (herein-after 33&34Vict.
called "the Act of 1870") the Commissioners were authorised to

sell surplus lands and to make leases as in that Act mentioned
Andby the Belfast Harbour Commissioners Act 1871 (herein-after 34&35Vict.
called "the Act of 1871") certain provisions of and incorporated c,xlu
with the Act of 1847 were explained and amended :
And whereas the requirements of the trade in and resorting to
the port and harbour of Belfast render it expédient that additional
works and improvernents in connexion with the harbour and its
approaches should be undertaken and that portions of the existing
harbour works or quays should be renewed or reconstructed and
that the further powers in respect thereof and otherwise as in this
Act mentioned should be conferred upon the Commissioners :

And whereas the debt of the Commissioners amounts to the sum
of seven hundred and forty-five thousand seven hundred and fiftv
pounds six shillings and fivepence and the Commissioners hâve no
power to borrow any further moneys except under the provisions of
the Act of 1854 and doubts hâve arisen whether the same can now
legally be exercised :
And whereas it has been found that the opération of certain
of
the rates authorised to be taken by or under the Act of 1847 has
been in practice attended with inconvenience and it is expédient
that the rates prescribed by the said Act or the schedules thereto
shoukl be in certain respects simplified and amended and with that
object that portions of the Act of 1847 should be repealed or varied
and new provisions made :
And whereas it is expédient that some of the powers and pro-
visions of the Acts herein-before recited should likewise be varied
and amended :
And whereas it is expédient in order to enable the Commissioners
from time to time to exécute the works authorised by the Acts
herein-before recited and to purchase the lands and exécute the
works by this Act authorised to be purchased and executed that
the Commissioners should be enabled to borrow further moneys in
the manner and subject to the conditions in this Act provided :
And whereas plans and sections showing the situation lines and
levels of the new works to be authorised by this Act and also the
lands which may be taken compulsorily for thepurposes thereof with
a book of référence to such plans containing the names of the
owners and lessees or reputed owners and lessees and of the occupiers
of the lands required or which may be taken for the purposes or
under the powers of this Act hâve been deposited with the clerk of
the peace for the county of Antrim and also with the clerk of the
peace for the county of Down (and thèse plans sections and book of
référence are in this Act referred to as " the deposited plans sections
and book of référence ") :
And whereas the several objects aforesaid cannot be effected
without the authority of Parliament :
May it therefore please Your Majesty that it may be enacted
and be it enacted by the Queen's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this présent Parliament assembled and by the
authority of the same as follows :
Short titie. 1. This Act may be cited as the Belfast Harbour Act 1882.

Provided always that the
provisions
of
the Harbours Docks and Piers Clauses Act 1847 with
respect
to
life-boats and with respect
to
keeping
a
tide and weather
gauge shall not
be in
force for
the
purposes
of
this Act except
so
far as may from time
to
time be required
by
the Board
of
Trade.

In this Act Interpreta-
The expression " the recited Acts " means and includes the Act
of 1847 the Act of 1852 the Act of 1854 the Act of 1870 and
the Act of 1871 :
The expression " port and harbour of Belfast " or " the port "
means and includes ail rivers streams pools mud-banks inlets
havens landing-places docks piers and quays lying within the
limits of the Commissioners jurisdiction as defined by the
recited Acts (that is) extending from the first weir across the
River Lagan near Annadale in the county of Down to Carrick-
fergus on the county of Antrim side of Belfast Lough and to
G-rey Point on the coast of the county of Down :
The word " lands " has the meaning attached thereto in section
two of the Act of 1870 and further means and includes any
slob lands and foreshore within the limits of the port and
whether above or below low-water mark ;
The expression " the harbour revenues " means and includes ail
rents rates tolls dues charges sums or payments whatsoever in
the nature of revenue in any way arising which may be
received by or payable to the Commissioners :
Ternis to which meanings are assigned in enactments incorpo-
rated with this Act or which hâve therein spécial meanings
hâve in this Act the same respective meanings unless there
be something in the subject or context répugnant to such
construction
:
In this Act (and for the purposes of this Act in enactments
incorporated with this Act)
" The company " or " the undertakers
