IIEREAS
there are in force in the borough
of
Birmingham
w
numerous local Acts and Orders confirmed by Parliament
which relate
to
the improvement and local government
of
t'he
borough including the supply
of
gas
and water and other matters
:
And whereas
it
would be
of
local
and
public advantage if the
enactments
of
those Acts and Orders were consolidated with certain
amendments and additions in one Act and it is expedient that. the
limits within which the Corporation are authorised
to
supply
gas
and water be altered
as
in this Act mentioned
:
And whereas it is expedient that the Corporation be empowered
to build assize courts and
to
borrow money
for
the purpose
:
And whereas William Barwick Cregoe Colmore
has
presented
to
the Corporation
a
valuable piece
of
freehold land
as
a
site
for
a
school
of
art and Richard and George Tangye and
an
anonymous
donor have placed at the disposal
of
the Corporation two several
sums
of
ten thousand pounds towards the erection
and
equipment
by
the Corporation
of
a
school
of
art
on
condition (among other
things) tliat the Corporation undertake its management and
maintenance
:
And whereas the donors
and
subscribers
to
the Birmingham
Society
of
Arts and School
of
Art at
a
special general meeting have
expressed their willingness on completion
of
the building
of
the
proposed new school of art to transfer to the Corporation the existing
School
of
Art carried
on
by the Society (including all their objects
of
art
and other property)
for
the purposes
of
the proposed new school
on
condition that the Corporation obtain the necessary Parlia-
mentary authority
for
the transfer and
for
carrying
on
the existing
School when t'ransferred at least

that the management
of
the
new scliool be entrusted to a committee
to be constituted
as
in this Act mentioned
:
And whereas
it
is expedient that powers be granted
for
carrying
into effect the above proposals in manner provided by this Act
:
And whereas
it
is expedient to empower the Corporation to
acquire for the purposes
of
this Act certain lands situate between
Holliday Street and the canal
of
the Company
of
Proprietors
of
tlhe
Worcester and Birmingham Canal Navigation
of
which lands the
greater portion
is
now occupied by the Corporation as
a
dep6t
for
receiving and storing goods and materials.
And whereas a plan showing the said lands and a book
of
reference containing the names
of
the owners and lessees
or
reputed
owners and lessees and of tlie occupiers of the same have been
deposited with the clerk of the peace for tlie county
of
Warwick
and are in this Act referred
to
as
the deposited plan and book
of
reference
:
And whereas the Corporation have borrowed and expended
upwards
of
one
hundred thousand pounds in erecting
on
freehold
land acquired by them
for
the purpose
a
second borough lunatic
asylum at Rubery Hill in the parish of
King's
Norton in the
county
of
Worcester whereof
a
balance
of
one hundred thousand
pounds
or
thereabouts was outstanding on the thirty-first day
of
December one thousand eight hundred and eighty-one and they
have also borrowed large slims
for
purposes of the street and
other improvcmcnts shown in the Eighth Schedule
to
this Act
whereof
a
balance amounting to fifty-six thousand nine hundred
and fifty-five pounds three shillings and threcpenee mas outstanding
on
the thirty-first day
of
December one thousand eight hundred
and eighty-one and thcy are required
to
repay or make provisions for
repayment
of
the said sums within thirty years from tlie respective
dates
of
borrowing the same and it is expedient having regard to
the permanent nature
of
the works and tlie improvements effected
by such outlay that the said period
be
extended to sixty years and
fifty years as in this Act provided.
And whereas
by
1851
it
is
enacted (among other things)
to
the efl'ect (section
63)
that
no
application shall be made to Parliament by the council for further
powers or for power to raise further sums
of
money
for
the purposes
of
that Act
or
for
the purposes of any further or other Act until
the council
shall
bp
notice given
for
two consecutive weeks in at
least two of the newspapers published in the borough have called a
public mecting
of
the
ratepayers
of
the borough at which meeting
the council
of
the borough sliall cause
to
be stated the object of the
intended application to Parliament,
nor
unless
at
such
meeting the

council shall be authorised by
a
majority of the ratepayers present

at such meeting to make such application
:
Provided always that
-
the mayor
of
the borough shall be the chairman
of
such meeting
and the voting at such meeting shall be according to the principle
established by the Acts
of
the fifty-eighth George the Third chapter
69
and fifty-ninth George the Tliird chapter
85
for
the regulation
of
vestries
:
Provided
also
bhat
if
a
poll shall be demanded at the said
meeting in respect
of
any
question
it
shall be open to all the rate-
payers within the borough during
a
period
of
three days next
following the holding
of
such meeting to signify their votes
in
writing in respect
of
such question and the same shall be decided by
the majority
of
votes
so
signified and the principle of voting shall
be in accordance with the principle to be adopted
at
the meeting
under the provisions
in
the said section contained
:
And whereas under the last-recited enactment the council
of
the
borough caused to be held
a
meeting
of
the ratepayers
of
the
borough
on
the eleventh day
of
December one thousand eight
hundred and eighty-two and at that meeting a resolution
was
duly
passed authorising the council to make
an
application to Parliament
for
an Act consolidating with amendments the local Acts and
Orders in force in the borough or some
of
them and
for
conferring
on
the Corporation further
powers
in relation to the improvement
and local government
of
the borough
:
And whereas the objects aforesaid cannot be attained without
the authority
of
Parliament
:
May
it
'therefore please Your Majesty that
it
may be enacted
and
be
it
enacted
by
the Queen's most Excellent Majesty by and with
the advice and consent of the Lords Spiritual and Temporal and
Commons in this present Parliament assembled and by the authority
of
the same as follows (that is to
say)

1.
This Act may be cited
as
the Birmingham Corporation
(Con-

solidation) Act
1883
and shall (save
as
otherwise expressly provided)

come into operation
on
the first day
of
January
one
thousand eight
hundred and eighty-four which date is hereinafter referred
to
as
the commencement
of
this Act.
