An Act for making a Railway from the Port of
Bristol to the Old Channel at the Mouth of the
River Avon, together with a Pier in the said
River; and for other Purposes.
[17th July 1862.]
W
HEREAS the making of a Railway from the Port of Bristol,
to commence at or near the Point where the HotweU Road
in the Parish of Clifton passes the Pier of the intended
Suspension Bridge over the River Avon, and to terminate in the Parish
of Westbury-upon-Trym in the County of
Gloucester
on the Shore of
the Old Channel at the Mouth of such River, and a Pier or Jetty into
the said River from the Terminus of the said intended Railway, would
be of great local and public Advantage: And whereas Plans and Sections
of the intended Railway and Pier or Jetty showing the Lines and Levels
thereof,
and also a Book of Reference containing the Names of the
Owners or reputed Owners, Lessees or reputed Lessees, and Occupiers of
the Lands through or upon which the same are intended to be made,
or which may be required for the Purposes of the Undertaking, have
been deposited with the Clerks of the Peace for the County of the City
of Bristol and the County of Gloucester: And whereas the Persons
herein-after named, with others, are willing at their own Expense to
carry the said Undertaking into execution if authorized by Parliament

tion of
Terms.
The Bristol Port Railway and Pier Act, 1862.
so to do, and are desirous of being incorporated into a Company (in this
Act called " the Company") for that Purpose: And whereas the several
Objects of this Act cannot be obtained without the Authority of Par-
liament
:
May it therefore please Your Majesty that it may be enacted;
and be it enacted by the Queen's most Excellent Majesty, by and with
the Advice and Consent of the Lords Spiritual and Temporal, and Com-
mons,
in this present Parliament assembled, and by the Authority of
the same, as follows ; (that is to say,)

" The Companies Clauses Consolidation Act, 1845," "The Lands
Clauses Consolidation Act, 1845," " The Lands Clauses Consolidation
Acts Amendment Act, 1860," " The Railways Clauses Consolidation Act,
1845,"
and " The Harbours, Docks, and Piers Clauses Act, 1847," (save
as to such Parts thereof respectively as are expressly varied or excepted
by this Act,) shall be incorporated with and form Part of this x\ct:
Provided always, that the Provisions of " The Harbours, Docks, and
Piers Clauses Act, 1847," with respect to Life Boats, and with respect
to keeping a Tide and Weather Gauge, shall not be in force under or for
the Purposes of this Act, unless and until and except only so far as the
Lords of the Admiralty, by Notice in Writing under the Hand of the
Secretary of the Admiralty to the Company, require the Company to
conform either wholly or in part to those Provisions respectively.

In construing the incorporated Acts in connexion with this Act the
Expression " the Undertaking " and the Expression " the Railway" in
" The Railways Clauses Consolidation Act, 1845," respectively mean the
Railway by this Act authorized and the Works connected therewith, but
not the Pier or Jetty, nor the Works connected therewith; the Expres-
sion " the Undertakers " in " The Harbours, Docks, and Piers Clauses
Act, 1847," shall mean the Company by this Act incorporated ; and in all
those Acts the Term " Superior Courts," and the Term " Courts of com-
petent Jurisdiction

shall respectively include any County or other Court
having by Law Cognizance of the Action; and in this Act the Expression
"' the Undertaking" includes as well the Railway by this Act autho-
rized and the Works connected therewith as the Pier or Jetty by this
Act authorized and the Works connected therewith, unless there be in
the Subject or Context hereof anything repugnant to or inconsistent with
such Construction.
Same Mean- 3. The several Words and Expressions to which by the Acts incor-
W^rds in P°rated with this Act Meanings are assigned shall have in this Act the
incorporated same respective Meanings, unless there be in the Subject or Context
Acts as in something repugnant to or inconsistent with such Construction, or other
Meanings be expressly assigned to them by this Act.
Short Title. 4. In citing this Act for any Purpose it shall be sufficient to use the
Expression " The Bristol Port Railway and Pier Act, 1862."
