Brooman fuit Plaintiff sur le Statute de 7 E. 6. cap. 7. pur buying de Seacoale, soil, que le Defendant ne eeant Wharfinger erne 100 Chaldrons pur 24 s. un Chaldron, & il tie conaume eux luy mesme ne vend euz al tiels persons per retaile que burn eux, mes vend eux pur gain, contra formau Statuti, &c. Heuden move que Seacole nest LITTLETON, 162. MICH. 4 OAR. IN COMMUNI BANCO 187 deins 1'entencon del Statute. Le Statute avoit 2 Branches, le primer pur Wood & Coale in lour Asaiae, que referre al Statute de 34 H. 8. cap. 3. & cest Statute restrain Coal aolemeut al Charcoal, & eat dit que serra 4 Bushels al chescun Sacke, que ne poet ee intend de Seacoal. 2d Branch dit, no person shall Buy any auch Wood or Coal que doei ee intend de tiels Coals que fueront nosme devant, scil. Charcoale, & est plaine que Seacoal ne fuit en use al London al temps del feasans de cest Statute. Second Exception. Le Informacon eat que il vend 100 Chaldrons de Coale vocat Seaeoale, & Coale comprehend Charcoal cibien come Seacoal devant le vocat, raes ceo non allocatur. Car per Richardson & Yelverton ilsveignant per mere, mes sont digge bora del terre. Mes Hutton dit, que in Scotland in ascun lieus ils digge Coal hora del mere.
