[725] de terming hilarii, an. 1670, in B. R. 22 & 23 car. II. Monday January 23. Keeling, C.J. came on Jan. 31, not well; Twisden, Raynsford, Moreton, Justices. 1. BURGHESS OF DEVISES. Mandamus. Bartue prayed a mandamus for a capital burghess of the devises, and that they might retorn on oath, as Latch, 124, pi. 117, Audly's case, the Court granted the mandamus, but denied to compell any retorn on oath, but left the party to action sur case.
