[3Qth Jzcne 1845.3 HEREAS an Act was passed in the Session of Parlia- ment held in the Third and Fourth Years of` the Reign of Her present Majesty Queen Victoria, intittiled An 3 sr 4 I'ict. Act Jor opening a Street to Clerkenwell Green in the County of c.112. Middlesex, in continuation of the new Street from Farringdon Street in the City of London : And whereas another Act was passed in tlie Session of Parliament held. in the Fifth and Sixth Years of the Reign of Her said present Majesty, intituled An Act to alter and amend the 5 ~i. tiVict. Provisions of the Act for opening a Street to Clerkenwell Green in (*.47. the County of Middlesex : And whereas it is expedient that Power should be granted to the Commissioners appointed by the said first- recited Act to make an Exteiision of the said Street to Clerkenwell Green, and also to form Three new Streets from and out of` the said last-nientioned Street : And whereas it is also expedient that the Period granted by tlie said first-recited Act for the Purchase of` the Lands, Houses, and other Property by such Act authorized to be purcliased should be extended, and that some of` the Provisions of` the said recited Acts should be altered and amended j but thc [Local.] 51 1'11 rposes 402 8" & 9" VICTORIE, Cap. xvii . Purposes aforesaid cannot be effected without the Aid and Authority of Parliament : May it therefore please Your Majesty that it may be enacted ; and be it enacted by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, That all the Provisions, Matters, and Things contained in the said recited Acts, so far as the same are now in force, and except such of them as are by this Act repealed, altered, or otherwise provided for, shall extend to this Act, and to the several Purposes and Things hereby authorized to be done, as fully and effectually as if the same Provisions, Matters, and Things were repeated and re-enacted in this Act in reference to such Purposes and Things. l'owers of lecited extended to this Act, Conmiis- sioners powered to make Exten- sion and Streets. 11. And be it enacted, That, subject to the Provisions and Restric- tions in the said recited ,4cts and this Act contained, it shall he lawful for the Commissioners, so soon as the said Street to Clerkenwell Green by the said firstly-recited Act authorized to be made shall be completed, to make an Extension of the said Street, and also to forin Three new Streets from and out ,of the said last-mentioned Street, which said Extension and new Streets will be situate in the Parishes of Saint James Clerkenwell, Saint Andrem Holborn, and Saint Sepulclwe, or some of then, in the County of Middlesex, and for the Purposes aforesaid to enter upon, take, and use the Lands mentioned in the Schedule (A.) to this Act annexed. Provisions of 111. ,4nd he it enacted, That all and every the Powers, Clauses, recited Acts and Provisions in the said recited Acts contained for enabling the as to Pur- chase of and Commissioners to purchase, agree for, or compel and complete Entry on Purchases for the Lands thereby authorized to be taken, and also Lands, &c. for regulating and directing the Ascertainment of and the Applica- to t"'s tion of the Purchase Money to be paid for the same, and the Act. Conveyance or other Assurance thereof to the Commissioners, of whatever 'Tenure the same may be, or whatever may be the Interest so purchased, and for Entry and obtainin5 Possession of such Lands, and all other Powers whatsoever in the said recited Acts contained in any Manner affecting the Mode of obtaining Possession of Lands, shall be and the same are hereby extended to the Commissioners, as far as regards the Lands to be purchased by them under this Act. And be it enacted, That the Powers of the Commissioners for the compulsory Purchase or taking of Lands for the malting of such Extension and new Streets shall not be exercised after the Expiration of Five Years from the passing of this Act. compulsory ~xten(iing V. And be it enacted, That the Period by the first-recited Act Tim fort]"r- granted for the purchasing and paying for, taking or using of Lands, shall be and the same is hereby extended and enlarged until the c !mi ng L taJ5. Twenty-third Day of July One thousand eight hundred and forty- eight, so far as regards the Lands mentioned or referred to in the Schedule (B.) to this Act annexed. VI. And 8" & 9" VICTQRIAE, Cap.xvii. 403 VI. And for the Purpose of making Provision for correcting any Errors and Olnission, Misstatement, or erroneous Description in the Schedules Onlissions tu be corrected. to this Act, be it enacted, That the Correction of any such Matter may be referred by the Commissioners to the Determination of' Two Justices for the County of Middlesex; and if it shall appear to sach Justices that such Omission, Misstatement, or erroneo~is Description arose from Mistake, they sliall certify the same accordingly, and they shall in such Certificate state the Particulars of any such Omission, and in what respect any such Matter shall have been misstated or erroneously described, and thereupon tlie Schedules to this Act shall be deemed to be corrected according to such Certificate, and it shall be lawful for the Commissioners to proceed in the Execution of this Act and the recited Acts, in accordance with such Certificate. VII. And whereas it is by the said firstly-recited Act enacted, Repealitig that the Commissioners should, within a reasonable Time after the Provision first-reci ted Principal and Interest of all Monies due and all Expences incurred Act as to in pursuance of that Act should have been paid off, pay to their Payment of respective Overseers of the Poor for the Time being of the several Surplus Parishes and Districts therein mentioned which should have contri- ~?'~~~," buted towards the Expence of opening the said new Street from Furringdon Street to Clerkenwell Green, as in the said Act mentioned, in aid of the Rates for the Relief of the Poor in such Parishes or Districts respectively, any Monies which might then remain in their Hands or the Hands of' their Treasurer, in such Sums and Pro- portions, to be determined by the Commissioners, as the Contributions of each such District and Parish might bear to the total Amount of' the Monies so remaining in the Hands of the said Commissioners or their Treasurer as aforesaid : And whereas it is anticipated that a considerable Sum of Money will remain in the Hands of' the said Commissioners, to be divided as aforesaid amongst the said Parislies and Districts, and it has been agreed between the Commissioners and the said Parishes and Districts that such surplus Funds should be applied towards the Expence of making the Extension of the said Street and forming the said new Streets by this Act authorized, ant it is therefore expedient that the said recited Provision should be repealed; be it therefore enacted, That the same shall be and is hereby repenled. VIIE. And be it enacted, That it shall be lawful for the Commis- Commis- sioners to apply any surplus Funds which may remain in their sionersn'ay Hands after Payment of the Principal and Interest of all Monies apply p,os inpa!il,g Sur- rille and all Expences incurred in the Formation and opening of the Expence of new Street authorized to be opened by the said firstly-recited Act, Iniprove- towards the Expence of making the Extension of' the said Street, nlents under this Act. and f'ortning the said new Streets by this Act authorized, any or either of them, as the Commissioners shall think proper. IX. And be it enacted, That if any surplus Money shall remain If any sur- iinappropriated in the Hands of the Commissioners after Payment of' plus remailis, all the lkpences incurred in pursuance of this Act and the said ~~l~~~~'~!~d recited Acts, such Surplus shall, within a reasonable Time, be paid by the Conimissioners to the respective Overseers of the Poor fbr the contribiiting. Time being of the several Parishes and Districts contributing towards the Expence of opening the said Street by the said firstly-recited Act authorized to be opened, in aid of the Rates for the ltelief of` the Poor in such Parishes and Districts respectively, such Payment to be made in such Sums and Proportions as the Commissioners shall determine the Contributions of each such Parish and District shall bear to the total Amount of` the said surplus Monies so remaining as aforesaid, and from and after such Payment all tlie Powers and Authorities vested in the Commissioners by the said recited Acts and this Act shall cease and determine.
