had been found necessary for the protection from
inundation by the sea of tlic Island
of
Canvey in the county
of

Essex
to
raise
a
wall or embankment round
it
and to cxecute
drainage and otllcr works and certain lands in the island known as
the Third Acre Lands were chargeable with the maintcnancc of
those works
:
And whereas since
the
construction of the said cmbanknicnt and
beforc the passing of the Act herein-after mentioned ccrtain lands
known as Outsands had been reclaimed at different times froiii tlic
sea by private persons and added to the island
and
works for tlicir
protection had been executed and wcrc maintained by such persons
:

And whereas
by
that Act (herein-after called thc Act
of
1792)
it
was enacted to thc following cffect (that is to say)
:
(i,) A body of Commissioners was constituted for tlic exccution

(except the works executed by private persons for the protcc-
tion
of
the Outsands) were as well as the works
to
be executed
by the Commissioners under tlie said Act vested
in
the Com-
missioners and they were entrusted with the duty
of
maiutain-
ing the
works
so
vested and
of
executing and maintaining such
other works
as
should be necessary
for
the protection and
drainage
of
the island and werc authorised to makc rules and
orders for executing the several powers
of
the
Act

(ii.) The Commissioners were invested with powers
of
getting

materials and acquiring lands in the island for thc: purposes
of
bhc Act

(iii.)
The Comniissioncrs were directed to raise the requisite
sums
for
the purposes of the Act by
an
annual rate
on
the
owners
OF
occupiers of the Third Acre Lands to the full value
of
those lands
if
necessary but
if
not
then by a pro tanto rate
on
those owners
or
occupiers
;
(iv.)
In
the event of the moneys to be raised not amounting
to
thc requisite sums the Commissioners were empowered
to
supply the deficiency by
an
annual rate on the owners
or
occupiers of the other lands in the island (except the
Out-
sands) which other lands are known
as
the Freelands
;
(v.) The Commissioners were authorised from time to time
to
entcr
on
and inspect the works executed
as
aforesaid
for
the protec-
tion of the Outsands and
to
enforce their maintenance in
proper repair and condition.
And whereas tlie Commissioners have executed the Act
ol
1792
and have rated the Third Acre Lands annually pursuaiit to the said
Act but except for about twenty pars aftcr thc passing of tlie said
Act and again in thc years 1837 to 1839 and
in
tlie years 1881
1882
and
1883
no
rates have been levied on the Freelands
under
the
said Act
:
And whereas
it
is expedient that the Commissioners be recon-
stituted and incorporated
:
And whereas the walls
of
the island were seriously damaged by
storms and high tides in the month of January 1881 and
it
has
become necessary to provide
a
large sum of money
for
their repair
and the Commissioners do not
at
present possess any statutory
powers of borrowing money
:
And’whereas certain
of
the works vested in tlhe Commissioners
have become useless by reason of the execution
of
the works executed
as aforesaid for the protection of the Outsands
:
And whereas
it
is reasonable and expedient for the benefit
of
the
whole island that the distinction between thc Outsands and the
Freelands be abolished
on
condition of the Commissioners taking
over and maintaining tlie works executed as aforesaid for the pro-
tection
of
the Outsands and that such
of
the Commissioners’ works
as have or may become useless be discontinued and fresh provisions
be made respecting the rating
of
all the lands in the island for the
PUrJJOSeS
of
the Act of 1792 and this Act and that borrowing powers
be conferred
on
the Cornmissioners
:
And whereas a plan showing the
works
executed
as
aforcsaid for
the protection
of
the Outsands (herein-after called
