DECISION
This decision is the decision of the above panel which convened via telephone
conference on 2 April 2020.
The appeal
1. The Appellant appeals against the Respondent’s decision dated 26 February
2020 to suspend her registration as a child minder on the early years register
and the compulsory part of the childcare register for six weeks until 7 April 2020.
The hearing
2. The Appellant asked for a determination on the papers. The Respondent
agreed to proceed without an oral hearing. We apply Rule 23 Tribunal
Procedure (First-tier Tribunal) (Health, Education and Social Care) Rules 2008
and consider this appeal suitable for determination without an oral hearing.
3. The Tribunal adjourned the appeal on 23 March 2020 to enable the Respondent
to provide more evidence and, if so advised, to apply for an order under Rule
14(2) to withhold evidence from the Appellant. An application was then made
and refused, following which, on 27 March 2020 further evidence relied on was
disclosed to the Tribunal and the Appellant. The Tribunal adjourned again on
30 March 2020 to allow the Appellant more time to seek legal advice in relation
to the additional evidence.
4. The Tribunal makes a restricted reporting order under Rule 14 (1) (a) and (b)
of the Tribunal Procedure (First-tier Tribunal) (Health, Education and Social
Care Chamber) Rules 2008, prohibiting the disclosure or publication of any
