DECISION
The Appeal
1. Mr Dean Millar, a proposed Registered Manager (‘the Appellant’), appeals
pursuant to section 32 of the Health and Social Care Act 2008 (‘the Act’), to the
Tribunal. The appeal relates to a decision of the Care Quality Commission (‘the
Respondent’) dated 4 September 2019 to refuse registration of the Appellant
as a manager in respect of the regulated activity ‘accommodation for persons
who require nursing or personal care’ at Cowbridge Residential Care Home,
Rose Hill, Lostwithiel PL22 0JW.
The Hearing
2. The hearing took place on 14, 15 and 16 July 2020. This was a remote hearing
which was not objected to by the parties. The form of remote hearing was by
Kinly CVP video. A face to face hearing was not held because it was not
practicable and no-one requested the same. The Tribunal noted that the
hearing had been listed in April 2020, but did not proceed due to the restrictions
in light of Covid-19. We considered that the issues in this appeal could be
