[120] le case de desbunnet & ferbanke deux dughmen. Un devise que ses terres measons & biens serront equally devided per ses executors inter ses 4 files, queux sont marry al barons; les legatees sue pur legacies in Court Christian ; et executors priont prohib'; pur ceo que terres & measons ne sonb testa-mentory ; & ils n'ont jurisdiction de compeller 1'executor de payer ceux legacies ; et le volunt le testator fuit, que les legatees averont les terres & biens in hotchpot, pur que quant 1'execution del volunt que est temporal est al Court Temporal, ils ne poient meddle in 1'execution de ceo volunt; & prohibition est grantable per touts ; et touts les justices agree, que serra mischievous de prohibiter le Court Ecclesiastical pur le personal estate: quia quant a ceo 1'execution del volunt appent a eux ; et si nous agai'domus prohibition pur les biens, nous ne poyomus faire droit al parties ; et issint 1'executors doyent retayner touts foits.
