The Cayman Islands Constitution (Amendment) Order 1972

The Queen's Most Excellent Majesty in Council

Her Majesty, by virtue and in exercise of the powers vested in Her by sections 5 and 7 of the West Indies Act 1962(a) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1. This Order may be cited as the Cayman Islands Constitution (Amendment) Order 1972 and shall come into operation on 21st June 1972.

2.—(1) The Interpretation Act 1889(b) shall apply with the necessary adaptations for the purpose of interpreting and otherwise in relation to this Order as it applies for the purpose of interpreting and in relation to an Act of Parliament.

(2) This Order shall be construed as one with the Cayman Islands Constitution Orders 1965 to 1971(c) and those Orders and this Order may be cited together as the Cayman Islands Constitution Orders 1965 to 1972.

3. Section 26 of the Constitution of the Cayman Islands is amended by the deletion of paragraphs (a) and (b) and the substitution of the following:—

"(a) is a British subject of the age of eighteen years or over; and

(b) either has been ordinarily resident in the Islands for a period or periods amounting to at least five years out of the seven years immediately preceding the date of registration and is resident therein at that date, or is domiciled and resident therein at that date.".

4. A person who, immediately before the commencement of this Order, was registered as an elector for elections to the Assembly but who is not entitled to be so registered under section 26 of the Constitution of the Cayman Islands, as amended by this Order, shall nevertheless be entitled to be so registered on the first register of electors compiled after the commencement of this Order provided that he...
