FiEingham [1906], P. 186; see the law commented on in Stillingfleet's Ecclesiastical Cases, vol. 2, pp. 48, et seq., and in Phillimore's Ecclesiastical Law (2nd ed.), vol. 1. pp. 11, et seq.] Upon special verdict it appeared that one C. was deprived for preaching against the common prayer; held, though there was another punishment appointed by the statute, and not deprivation until the second offence, the Bishop of London and his colleague! by virtue of the high commission to them and others directed, might proceed by the ecclesiastical law, and deprive him for the first; it being against the duty of his office as a minister, and they having power to purge their body of all scandalous members. The form of the sentence was, " that the said bishop by and with the consent of others of the said commissioners, his companions," &c. : held, the sentence is good. The Act gave jurisdiction to the Crown to name such commissioners as be natural born subjects. A special verdict need not find that the commissioners appointed K. In the term of St. Hilary, in tha 33d year of the reign of Queen Elizabeth, Eotulo 340, Robert Caudrey, clerk, brought an action of trespass against George Atton, for breaking of his close at North Luffenham in the county of Rutland, the 7th day of August in the 31st year of the reign of the said late Queen : the defendant pleaded not guilty, and the jury returned and sworn for trial of this issue gave a special verdict, that is, they found the truth of the case at large referring the same for the law to the judgment of the Court, to this effect: they found that the plaintiff before the trespass supposed to be done, was parson of the Rectory of South Luffenham in the county aforesaid, whereof the place wherein the trespass is alledged was parcel, and found the statute made in the first year of the said late Queen's reign by which in effect it is enacted, that such jurisdiction ecclesiastical, as by any spiritual or ecclesiastical [1 b] power hath heretofore been, or may lawfully be exercised for the visitation of the ecclesiastical estate and persons, and for reformation, order, and correction of the same, and of all manner of errors, heresies, schisms, abuses, offences, òcontempts, and enormities, within this realm, should for ever be united and annexed to the Imperial Crown of this realm. And that Her Highness, her heirs, and successors, "should have full power and authority, by virtue of that Act, by letters patent under the Great Seal of England, to assign, nominate and authorise such persons, being natural-born subjects, as Her Highness, her heirs, or successors, should think meet, to exercise and execute under Her Highness, her heirs, and successors, all and all manner of jurisdiction, privileges, and pre-eminences in any wise touching or concerning any spiritual or ecclesiastical jurisdiction within this realm of England and Ireland, and to visit, reform, redress, order, correct, and amend, all such errors, heresies, schisms, abuses, offences, contempts, am] enormities whatsoever, which by any (manner) spiritual or ecclesiastical power, authority, or Termino Hilarii, anno 33 regni Elizabethan Rotulo 340 Robertas Caudrey clericus in jus vocavit G-eorgium Atton de actione transgressionis, quod clausum suum. ad North Luffenham in comitat' Rutlandise perfregisset die septimo Au-gusti, anno regni predicts Regime trice-simo primo : defendens respondit se minima esse reum; juratores evocati & jurati veredictum dederunt speciale, videlicet rem esse veram comperuerunt, de jure autem ad judicium Curisa referentes in hanc sententiam, comperuerunt queren-tem ante transgressionem fuisse rectorem rectoriie de South Luffenhamc in comitatu prffidicto, & locum in quo damnum fuit illatum, esse partem ejusdem rectoriie, comperuerunt item statutum factum atino ejusdem Reginse primo, quo sancitum in hane sententiam fuit, quod ea ecclesiastica jurisdictio, qiuB aliqua potestate spiritual!, vel ecclesiastica jam ant' exercebat', vel legitime exerceri poterat ad visitand' ecclesiasticum statam & ordinetn, item ad reformandum, in ordinem redigendum, & corrigendum homines ecclesiasticos, omnimodos errores, haareses, sehismata, abusus, offensas & enormitates intra hoc regnum imperial! hujus regni diademati in perpetuum uniretur & adjuugeretur.
