OHAPTER clxxiü.
An Act for the construction of certain Eailways between
A.D.
1887.
the Holy Loch near Dunoon and Lochgilphead Ardrishaig
and Crinan Loch with Piers in connection therewith all
in the county of Argyll and for other purposes.

TTJ HEBE AS the construction of the railways and piers in con-
» » nection therewith in the county of Argyll hereinaf ter described
would be of public and local advantage:
And whereas the persons in this Act named with others are
willing at their own expense to make and maintain the said railways
and piers and it is expedient that they should be incorporated as a
Company with all proper and necessary powers for the purpose of
carrying the undertaking into execution:
And whereas it is expedient that the Company and the North
British Railway Company should be empowered to enter into and
carry into effect working and other agreements as by this Act
provided:
And whereas plans and sections showing the lines and levels of
the railways and certain of the piers authorised by this Act and
also books of reference containing the names of the owners and
lessees or reputed owners and lessees and of the occupiers of certain
of the lands required or which may be taken for the purposes or
under the powers of this Act were duly deposited with the principal
sheriff clerk for the county of Argyll at his office at Inveraray and
are hereinafter respectively referred to as the original plans sections
and books of reference:
And whereas since the said plans and sections were deposited
an arrangement has been entered into for the purchase by the
Company of the pier situate on the Holy Loch near Sandbank
belonging to the trustees of the deceased William Frederick Hunter
of Hafton and it is expedient that the Company should be autho-
rised to construct the pier being work sixth hereinafter described

1887. instead of the proposed pier on the Holy Loch shown on the said
plans and sections and that the Eailway No. 1 hereinaf ter described
should commence at the point of commencement of the said intended
pier being work sixth hereinafter described instead of at the point
shown on the said plans and amended plans and sections of the
said intended pier with a book of reference to such plans contaming
the names of the owners and lessees or reputed owners and lessees
and of the occupiers of the lands required or which may be taken
for the purposes of the said work sixth have been deposited with
the principal sheriff clerk for the county of Argyll at his office at
Inveraray and the same are hereinafter respectively referred to as
the amended plans sections and book of reference :
And whereas the purposes of this Act cannot be effected witliout
the authority of Parliament:
May it therefore please Your Majesty that it may be enacted and
be it enacted by the Queen's most Excellent Majesty by and with
the advice and consent of the Lords Spiritual and Temporal and
Commons in this present Parliament assembled and by the authority
of the same as follows :
Short
title.
X. This Act may be cited as the Olyde Ardrishaig and Crinan
Railway Act 1887.

Acts Amendment Act 1860 the Railways Clauses Consolidation
(Scotland) Act 1845 Part I. (relating to construction of a railway)
Part III. (relating to working agreements) and Part IV. (relating
to steam vessels) of the Eailways Clauses Act 1863 and the Harbours
Docks and Piers Clauses Act 1847 except section 25 and excepting
the provisions thereof with respect to life-boats and with respect to
keeping a ticle and weather gauge unless the Board of Trade shall
otherwise require are (except where expressly varied by this Act)
incorporated with and form part of this Act.
Interprefa- 3. In this Act the several words and expressions to which
meanings are assigned by the Acts wholly or partially incorporated
herewith have the same respective meanings unless there be some-
thing in the subject or context repugnant to such construction and
in this Act and the Acts wholly or partially incorporated herewith
as applied to this Act the expression "the Company" means the
Company incorporated by this Act the expression " the special Act"

means this Act the expressions " the railways" and " the under-

taking" mean respectively the railways and the undertaking
authorised by this Act the expression " the piers " means and includes
the piers authorised to be constructed and the pier authorised to
be acquired by this Act the expressions " the railway " and " a work "
mean and include the piers as well as the railways or any part
thereof and in this Act the expression " pier limits" and in the
provisions of the Harbours Docks and Piers Clauses Act 1847 incor-
porated with this Act the expressions " the prescribed limits " " the
limits of the harbour dock or pier

and " the harbour dock or pier "
and the word " pier" respectively mean the several piers by this
Act authorised to be constructed and the pier by this Act authorised
to be acquired and the limits thereof respectively by this Act
defined.

persons and corporations who have already subscribed to or shall
hereafter become proprietors in the undertaking and their executors
administrators successors and assigns respectively shall be and are
hereby united into a Company for the purpose of making and
maintaining the railways and the piers and for other the purposes
of this Act and for those purposes shall be and are hereby incor-
porated by the name of " the Clyde Ardrishaig and Crinan Railway
Company" and by that name shall be a body corporate with per-
petual succession and a common seal and with power to purchase
take hold and dispose of lands and other property for the purposes
of this Act.
5.
Subject to the provisions of this Act the Company may make Power to
and maintain in the lines and according to the levels shown on makera'1"
the original plans and sections and on the amended plans and
piers.

lands delineated on the said respective plans and described in the
original and amended books of reference as may be required for
that purpose The railways and piers hereinbefore referred to and
authorised by this Act are all situate in the county of Argyll and
are:
First. A railway (No. 1) eighteen miles five furlongs five chains
and eight decimal parts of a chain or thereabouts in length
being so much only of the Railway No. 1 laid down on the
original plans as extends from a point on that railway in the
united parishesof Dunoon andKilmun four furlongs five chains
