In exercise of the powers conferred on me by sections 4, 7 and 56 of the Food and Drugs (Scotland) Act 1956(a) as amended by section 4(1) of, and paragraph 3(1) of Schedule 4 to, the European Communities Act 1972(b), and of all other powers enabling me in that behalf, and after consultation with such organisations as appear to me to be representative of interests substantially affected by these regulations and after reference to the Scottish Food Hygiene Council under section 25 of the said Act of 1956 (insofar as the regulations are made in exercise of the powers conferred by the said section 7) I hereby make the following regulations:—
Citation, commencement and interpretation
1.—(1) These regulations may be cited as the Colouring Matter in Food (Scotland) Amendment Regulations 1976, and shall come into operation on 2nd February 1977 except that—
(a) the amendments made by regulation 2 hereof shall not have effect for the purposes of regulation 4 (which relates to the sale etc. of food containing colouring matter) and 5 (which prohibits the use of added colouring matter in specified foods but exempts husks containing nuts from the prohibition) of the Colouring Matter in Food (Scotland) Regulations 1973(c), as amended(d), and of any other regulations made under section 4 or 7 of the Food and Drugs (Scotland) Act 1956 until 1st January 1978;
(b) regulation 3 hereof shall come into operation on 1st January 1978.
(2) The Interpretation Act 1889(e) shall apply for the interpretation of these regulations as it applies for the interpretation of an Act of Parliament.
Amendment of the Colouring Matter in Food (Scotland) Regulations 1973
2. The Colouring Matter in Food (Scotland) Regulations 1973, as amended, shall be further amended—
(a) by deleting from the table in Part I of Schedule 1 thereto (which describes permitted colouring matters) and from Part II of that
(a) 1956 c. 30.
(b) 1972 c. 68.
(c) S.I. 1973/1310 (1973 II, p. 3961).
(d) The relevant amending instrument is S.I. 1975/1595 (1975 III, p. 5484).
(e) 1889 c. 63.
