In exercise of the powers conferred on me by section 98(1)(b) of the Local Government (Scotland) Act 1973(a) and of all other powers enabling me in that behalf, and after consultation with such associations of local authorities as appear to me to be concerned, I hereby make the following regulations:—
1. These regulations may be cited as the Commission for Local Authority Accounts in Scotland Regulations 1975 and shall come into operation on 16th May 1975.
2.—(1) The Interpretation Act 1889(b) shall apply for the interpretation of these regulations as it applies for the interpretation of an Act of Parliament.
(2) In these regulations unless the context otherwise requires—
"the Act" means the Local Government (Scotland) Act 1973;
"the Commission" means the Commission for Local Authority Accounts in Scotland established under section 97(1) of the Act;
"financial year" has the same meaning as in section 96(5) of the Act.
3. The expenses incurred by the Commission in connection with the proper discharge of their functions shall after deduction therefrom of the total amount of grants paid in respect thereof under section 98(1)(a) of the Act be met by the regional and islands councils and in relation to each financial year the amount estimated to be required shall be apportioned among the regional and islands councils in proportion to their respective products of a rate of one penny in the pound or their standard penny rate products, whichever in each case is the higher, for that year, estimated for each region or islands area in accordance with the provisions of section 12 of the Local Government (Scotland) Act 1966(c).
4. In relation to each financial year and not later than the date prescribed in regulations made under section 111(1) of the Act as the last date for joint committees and joint boards and water authorities to send requisitions to local authorities, the Commission shall notify each regional and islands council of the estimated amount of the expenses apportioned to them under article 3 of these regulations.
