In exercise of the powers conferred upon me by section 22(1) of the Local Government (Scotland) Act 1975(a) and of all other powers enabling me in that behalf, I hereby make the following order:—

1. This order may be cited as the Commissioner for Local Administration in Scotland (Designated Body for Scotland) Order 1975 and shall come into operation on 31st December 1975.

2.—(1) The Interpretation Act 1889(b) shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

(2) In this order:—

"the Commission" means the Commission for Local Authority Accounts in Scotland as established under section 97 of the Local Government (Scotland) Act 1973(c).

3. The Commission is hereby designated as the designated body for Scotland in terms of section 22 of the Local Government (Scotland) Act 1975.

EXPLANATORY NOTE

(This Note is not part of the Order.)

Part II of the Local Government (Scotland) Act 1975 sets up machinery for the investigation of complaints of maladministration by local and certain other authorities in Scotland. Investigations are to be carried out by the Commissioner for Local Administration in Scotland. The Commissioner will make an annual report on the discharge of his functions, and the designated body will arrange for its publication.
