UPON the application of the claimants by Notice/Part 8 Claim Form dated

AND IT IS ORDERED that

The Order for Sale

() the property described in the attached First Schedule (“the property”) be sold at such time and in such manner as the parties may agree or in default of such agreement as the Court may direct

() the Claimant may proceed with the above sale without seeking further directions from the Court [and the conduct of the sale be committed to the Claimant and the results of the sale be certified by the Claimant’s solicitor]

() the Claimant may sell the property by private treaty for not less than £

() the Defendant shall concur with the Claimant in [selling the above property

Auctioneers and reserve price

Access to the Property

() the Defendant shall undertake to allow prospective purchasers accompanied by estate agents instructed on the sale to visit the property at all reasonable times before the auction

() the Defendant shall on or before completion of the sale give vacant possession of the property to the purchaser of it

() the Defendant shall on or before (date) give the Claimant vacant possession of the property

Trusts and Incumbrances

() the Defendant shall concur with the Claimant in selling the above property under the statutory trusts affecting it and that the Defendant take all such steps and do all such things and execute all such instruments as may be necessary or convenient to implement the sale

() the statutory trusts affecting the above property be carried into execution

() the property be sold free from the incumbrances (if any) of such of the incumbrancers as consent to the sale and subject to the incumbrances of such of them as do not consent

() The Court declares that the Defendant holds the property on trust for the Claimant and the Defendant as tenants in common

Proceeds of sale

() unless otherwise agreed between the parties the proceeds of sale after payment of whatever is due to any incumbrancers according to their priorities and of all proper costs charges and expenses incurred in connection with the sale shall be lodged in Court to the credit of this claim [(Short Title and Number) "Proceeds of Sale of Freehold Property" subject to further Order][as directed in the attached Lodgment Schedule] OR

an inquiry as to what estates and interests and in what shares and proportions the Claimant and the Defendant respectively are interested in the property or the net proceeds of its sale taking into account the mutual dealings of the Claimant and the Defendant in respect of the property in relation to rents and profits or otherwise and the values of their respective occupations of the property

Conditional contracts

() the conditional contract dated and made between and for the sale to of the property be carried into effect OR

() the conditional contract dated and made between and be varied as set out in the attached Second Schedule and that as so varied be carried into effect

Delivery of deeds
