Cornhill's Case

[149] coknihll's case. Error lies in B. K. on a judgment in criminal cases in the same Court of Errors in fact or in law, and in civil cases in fact only. S. C. 1 Sid. 208. Q. 721. Error of a judgment given here on an indictment in London, against him for seducing him into an ill house, and there cheating him of 3001. removed hither by certiorari; and it was objected, that the writ lay not here upon a judgment given by themselves, and cited Read and Dawson's case about two years before, where the writ of error on a judgment in an indictment of perjury in this Court was brought in Parliament: the Court said, that proves that it may be brought in Parliament, not that it must; and they affirmed their jurisdiction, that error may be brought in this Court in cases criminal on judgments given in the same Court: but now in eases civil, except it be of errors in fact triable by jury.
